Although the two signs in question, Ipanema Espresso and Ipanema, were very similar and beer and coffee are both beverages, the EUIPO rejected the opposition filed by IPANEMA AGRICOLA against FAVELA CERVEJA’s trademark application.
In the Office’s view, the nature and purpose of beer and coffee clearly differ. They are generally produced and marketed by different operators and distribution channels.
