Amendments to the EU trademark regulations will come into force on 1st October 2017, among others:

  • It will be possible to file certification marks before the EUIPO. This kind of specific marks already exists in many national laws, such as in France. They shall be filed with regulations on their use (goods /services to be certified, conditions of the use, control measures, etc)
  • Translations of evidence into the language of the proceedings will no longer be always mandatory, they will only be on request by the Office
  • Removal of the representation requirement making it easier to register non-traditional trademarks (sounds, holograms, etc)
  • Document evidencing priority claims must be filed within 3 months of the filing
